Following the granting of a rule nisi (interim order) on extreme urgency on 5 November 2025 by Cooper AJ, which interdicted and restrained Open Secrets NPC, the First Respondent, from reporting on the conduct of Integrated Convoy Protection, the Applicant, the interim order has been discharged and the application has been dismissed by Erasmus ADCJ, with reasons to follow.
Erasmus ADCJ also awarded punitive costs against the Applicant.
This is an important outcome for press freedom and open justice, and reaffrims the importance of the free flow of information that is in the public interest.
The order, dated 27 November 2025, reads as follows:
- The rule nisi granted on 5 November by Cooper AJ is discharged.
- The application is dismissed.
- The applicant is to pay the costs of the first and second respondents on an attorney and client scale.
- No order as to costs for the amici curiae applications.
