Protecting and promoting freedom of expression in Marikana
Case overview: Power & Associates assisted two community activists from Marikana in the North West Province with filing answering affidavits in an application for a protection order filed by Tharisa Minerals (Pty) Ltd (Tharisa Minerals), a mining company operating in Marikana, and Mr William Mpembe (Mr Mpembe), the former North West deputy police commissioner, in terms of the Protection from Harassment Act. The application was filed in the Rustenberg Magistrates’ Court. The activists argued, among other things, that the application unduly restricted their right to freedom of expression. Following the filing of the answering affidavits, the application was withdrawn by Tharisa Minerals and Mr Mpembe and the interim protection order was abandoned.
