Advice to the Mail & Guardian on a take-down notice
In September 2019, the Mail & Guardian (M&G) received a take-down notice in terms of section 77 of the Electronic Communications and Transactions Act, 2002 (ECTA), demanding the removal of certain content on the M&G website. M&G consulted with Power Singh Inc., in order to respond to the take-down notice. In the light of the response provided, the internet service provider determined that M&G had not contravened the provisions of ECTA, and the content therefore remained accessible on the website without interruption.
