Case overview: The Greater Kyalami Conservancy (GEKCO), represented by Power & Associates, has instituted an application to review and set aside a decision by the Chairperson of the City of Johannesburg’s Municipal Planning Tribunal (MPT). The application is as a result of a decision in which the Respondent found GEKCO and its duly elected chairperson, Ms Kristin Kallesen, did not have the requisite locus standi to object to certain township establishment applications between 2014 and 2018. The application is brought in terms of the Promotion of Administrative Justice Act 3 of 2000 and the principle of legality. Century Property Property Developments (Pty) Ltd and Riversands Developments (Pty) Ltd are also cited as respondents in the application as they initially lodged the township establishment applications in question and challenged GEKCO and Ms Kallesen’s legal standing to raise objections.
