South Africa: Call for nominations or applications for the Public Protector

On 12 June 2023, the Parliament of South Africa’s Ad Hoc Committee responsible for selecting a candidate for the position of Public Protector (PP) issued an invitation for organisations and members of the public to nominate suitable candidates or for candidates to make application.

The Public Protector, established in accordance with Chapter 9 of the Constitution, is a state institution that supports constitutional democracy. The PP’s role is to investigate alleged or suspected improper conduct in state affairs or public administration across all levels of government. The PP reports on such conduct, takes appropriate remedial action, and possesses other powers and functions as prescribed by national legislation.

The President appoints the Public Protector for a non-renewable term of seven years based on the recommendation of the National Assembly. To be eligible for the position, candidates must be South African citizens, deemed fit and proper for the office, and meet one of the following criteria:

  1. Be a Judge of a High Court;
  2. Be admitted as an advocate or attorney with at least 10 years cumulative practice;
  3. Be qualified for admission as an advocate or attorney with at least 10 years cumulative lecturing experience in law at a university;
  4. Possess specialised knowledge or experience in the administration of justice, public administration, or public finance for at least 10 years;
  5. Have served as a Member of Parliament for at least 10 years; or
  6. Demonstrate a cumulative combination of the abovementioned types of experience for at least 10 years.
